RESPONSIBILITIES OF THE mitigation specialist:
Provide a thorough social history investigation
Prepare requested report
Pre-screen the defendant to identify, mental illness, treatment and other needs
Make referrals if necessary to other experts and treatment programs
Explore case options in consultation with the attorney
Act as a liaison between the lawyer and the defendant
Contact victims and facilitate requests for restorative justice
Obtain effective character support letters from friends and relatives
Assist client in writing statement for court appearance
Assist in the coordination of events at sentencing hearing
Provide regular updates to the attorney as agreed upon or as necessary
ATTORNEY RESPONSIBILITIES IN THE CONSULTING PROCESS:
Bring the mitigation specialist into the case as early as possible
Communicate clearly expectations of the defense
Keep the mitigation specialist informed of case developments and court hearing dates
Provide the sentencing consultant with any needed resources
Assist in obtaining pertinent records as needed, i.e. court order
Prepare consultant for anticipated testimony and cross-examination
Maintain a willingness to listen to ideas
