Responsibilities of the Sentencing Consultant:
- Provide a thorough social history investigation
- Prepare a sentencing report
- Pre-screen the defendant to identify treatment and other needs
- Make referral to appropriate expert and treatment programs
- Explore case options in consultation with the attorney
- Act as a liaison between the lawyer and the defendant
- Contact victims and facilitate requests for restorative justice
- Obtain effective character support letters from friends and relatives
- Assist client in writing statement for court appearance
- Assist in the coordination of events at sentencing hearing
Attorney Responsibilities in the Consulting Process:
- Bring the Sentencing Consultant into the case as soon as possible
- Communicate clearly expectations of the defense, don’t assume
- Keep the Sentencing Consultant informed of case developments
- Maintain a willingness to listen to ideas
- Provide the Sentencing Consultant with any needed resources
- Prepare for anticipated testimony and cross-examination
Above all else, the consulting relationship is collaborative.
